Eligibility

Argentina Citizenship by Investment: Eligibility

The legal requirements, the compliance filters and the profile factors that determine whether an application is viable.

Direct Answer

Any foreign national of legal age may apply, regardless of prior residence in Argentina, if they make a qualifying investment (USD 350,000 contribution or USD 800,000 public security) and pass the Government's due diligence. Capital is necessary but not sufficient: the lawful origin of the funds, identity, criminal background, sanctions exposure and immigration history are decisive.

01

Legal Basis of Eligibility

Decree 366/2025 amended Citizenship Law 346 to allow foreign nationals who make a relevant investment in Argentina to apply for citizenship regardless of the length of their residence. The Ministry of Economy determines which investments qualify, and Decree 524/2025 sets the evaluation procedure.

Eligibility therefore has two components: a qualifying investment and a favourable evaluation by the Agency for Citizenship by Investment Programs, followed by the decision of the National Migration Directorate (DNM).

02

Core Eligibility Requirements

  • Foreign nationality and legal age (minors apply only as family members)
  • Qualifying investment under one of the two announced routes
  • Lawful and traceable source of funds for the investment
  • Documented source of wealth consistent with the applicant's profile
  • Clean criminal background in the relevant jurisdictions
  • No sanctions exposure and acceptable reputational profile
  • Valid identity and civil-status documents

Prior residence, physical presence, Spanish language and minimum stay requirements have not been established for this pathway.

03

Investment Capital

The principal applicant must make either a USD 350,000 non-refundable contribution to the National Treasury or a USD 800,000 subscription to a public security created for the program. Family members add the announced amounts (USD 100,000 for a spouse and each eligible adult child; USD 25,000 for each child under 18).

Applicants should also budget for government fees, professional fees, translations, apostilles and due diligence costs. See Investment Routes.

04

Source of Funds and Source of Wealth

Source of funds is the specific money used for the investment: where it is held and how it reached that account. Source of wealth is how the applicant built their overall net worth. Both must be coherent and supported by documents.

Typical evidence includes company accounts, dividend records, sale agreements for shares or real estate, employment income, inheritance documentation and bank statements showing the movement of funds. Cash, unexplained transfers, cryptocurrency without a clear audit trail and funds moved through opaque structures require particular care.

05

Criminal Background and Sanctions

Criminal record certificates are reviewed for the country of nationality and countries of residence. Pending proceedings and past convictions are relevant, particularly those related to financial crime, corruption, terrorism or organised crime.

Applicants are screened against international sanctions lists. Politically exposed persons are not excluded as such, but are subject to enhanced due diligence.

06

Immigration History

Prior visa refusals, deportations, overstays or immigration violations in any country may be relevant and should be disclosed accurately. Inconsistencies between declarations and records are a frequent cause of adverse findings.

07

Nationality Restrictions

No list of excluded nationalities has been published. In practice, applicants from high-risk or sanctioned jurisdictions should expect more extensive review and may face banking difficulties when transferring funds. A preliminary legal assessment is recommended in these cases.

08

Dual Citizenship

Argentina does not require new citizens to renounce their existing nationality. Whether the applicant's current country permits dual citizenship depends on that country's law and must be checked separately.

09

Preliminary Legal Assessment

Before any funds are committed, a confidential review by an Argentine CBI attorney can identify obstacles in the profile, the funds or the family composition. This is the most efficient way to avoid an application that is unlikely to succeed. Discuss an Argentina CBI case.

Assessing a specific case

Eligibility depends on nationality, background, source of funds and family structure. A review by Argentine counsel is the appropriate first step — no outcome can be promised in advance.
